HİZMET SÖZLEŞMESİ

1. Taraflar

İşbu Hizmet Sözleşmesi, MASLAK KONAKLAMA A.Ş. (bundan sonra "Otel" olarak anılacaktır) ile internet sitesi üzerinden ödeme gerçekleştiren müşteri (bundan sonra "Misafir" olarak anılacaktır) arasında akdedilmiştir.

MASLAK KONAKLAMA A.Ş., Somerset Maslak İstanbul markası altında konaklama hizmetleri sunmaktadır.

2. Sözleşmenin Konusu

İşbu sözleşmenin konusu, Misafirin MASLAK KONAKLAMA A.Ş. tarafından sunulan konaklama ve ilgili hizmetlere ilişkin ödemelerini elektronik ortamda gerçekleştirmesine ilişkin usul ve esasların belirlenmesidir.

3. Ödeme Süreci

Misafire rezervasyon veya hizmet talebi kapsamında e-posta yoluyla bir ödeme bağlantısı (ödeme linki) gönderilir.

Misafir, kendisine iletilen ödeme bağlantısı üzerinden açılan güvenli ödeme sayfasında ödeme bilgilerini girerek işlemi tamamlar.

Ödeme işleminin başarıyla sonuçlanması halinde ilgili rezervasyon veya hizmet talebi işleme alınır.

Otel, gerekli gördüğü durumlarda rezervasyonun doğrulanması amacıyla ek bilgi ve belge talep edebilir.

4. Misafirin Hak ve Yükümlülükleri

Misafir;

• Ödeme sırasında verdiği bilgilerin doğru ve güncel olduğunu,
• Kullanılan ödeme aracının kullanım hakkına sahip olduğunu,
• Rezervasyona ilişkin bilgileri kontrol ederek ödeme yaptığını,
• İşbu sözleşme ile internet sitesinde yayımlanan diğer politika ve kurallara uyacağını,

kabul ve taahhüt eder.

5. Otelin Hak ve Yükümlülükleri

Otel;

• Sunulan hizmetlerin yürürlükteki mevzuata uygun şekilde sağlanmasını,
• Ödeme işlemlerinin güvenli sistemler üzerinden gerçekleştirilmesini,
• Misafire ait bilgilerin gizliliğinin korunmasını,

taahhüt eder.

Otel, teknik bakım, sistem güncellemesi veya üçüncü taraf hizmet sağlayıcılarından kaynaklanan nedenlerle hizmetlerde geçici kesinti yaşanması halinde sorumlu tutulamaz.

6. Fiyatlandırma ve Tahsilat

Hizmet bedelleri rezervasyon sırasında veya misafire gönderilen ödeme talebinde belirtilen tutarlar üzerinden tahsil edilir.

Vergiler ve diğer yasal yükümlülükler yürürlükteki mevzuata uygun şekilde uygulanır.

7. İade Edilemeyen Rezervasyonlar (Non-Refundable Reservations)

Erken rezervasyon, ön ödemeli rezervasyon (Advance Purchase) veya rezervasyon aşamasında açıkça "İade Edilemez (Non-Refundable)" olarak belirtilen rezervasyonlarda, rezervasyon onaylandıktan sonra iptal, değişiklik veya ücret iadesi yapılamaz.

Bu rezervasyonlar kesin rezervasyon niteliğinde olup, ödeme tamamlandıktan sonra tahsil edilen tutar geri ödenmez.

8. İptal ve İade

Rezervasyon iptalleri, iade koşulları ve diğer ilgili hususlar internet sitesinde yer alan "İptal, İade ve Gizlilik Sözleşmesi" kapsamında değerlendirilir.

9. Gizlilik

Misafirlere ait kişisel bilgiler yalnızca rezervasyon, ödeme, muhasebe ve müşteri hizmetleri süreçlerinin yürütülmesi amacıyla kullanılır.

Kişisel verilerin korunmasına ilişkin esaslar internet sitesinde yayımlanan "İptal, İade ve Gizlilik Sözleşmesi" kapsamında düzenlenmektedir.

10. Uygulanacak Hukuk ve Yetki

İşbu sözleşmenin uygulanmasından doğabilecek uyuşmazlıklarda Türkiye Cumhuriyeti Kanunları uygulanır.

11. Yürürlük

Misafir, internet sitesi üzerinden ödeme işlemini tamamladığında işbu Hizmet Sözleşmesi hükümlerini okuduğunu, anladığını ve kabul ettiğini beyan etmiş sayılır

SERVICE AGREEMENT

1. Parties

This Service Agreement is entered into between MASLAK KONAKLAMA A.Ş. (hereinafter referred to as the "Hotel") and the customer making a payment through the website (hereinafter referred to as the "Guest").

MASLAK KONAKLAMA A.Ş. provides accommodation services under the Somerset Maslak Istanbul brand.

2. Subject of the Agreement

The purpose of this Agreement is to determine the terms and conditions governing the Guest's electronic payment for accommodation and related services provided by MASLAK KONAKLAMA A.Ş.

3. Payment Process

A payment link will be sent to the Guest via e-mail regarding the reservation or requested service.

The Guest shall complete the payment transaction by entering the required payment information on the secure payment page accessed through the payment link provided.

The relevant reservation or service request shall be processed upon successful completion of the payment transaction.

The Hotel reserves the right to request additional information or documentation when deemed necessary for reservation verification purposes.

4. Rights and Obligations of the Guest

The Guest agrees and undertakes that:

• The information provided during the payment process is accurate and up to date;
• The payment instrument used belongs to the Guest or is used with proper authorization;
• The reservation details have been reviewed and approved before making payment;
• The Guest will comply with this Agreement and all other policies published on the website.

5. Rights and Obligations of the Hotel

The Hotel undertakes:

• To provide its services in compliance with applicable laws and regulations;
• To ensure that payment transactions are processed through secure systems;
• To protect the confidentiality of Guest information.

The Hotel shall not be held liable for temporary service interruptions caused by technical maintenance, system updates, or issues arising from third-party service providers.

6. Pricing and Collection of Payments

Service fees shall be collected based on the amounts specified in the reservation details or payment request sent to the Guest.

Taxes and other legal charges shall be applied in accordance with applicable legislation.

7. Non-Refundable Reservations

For Advance Purchase reservations, prepaid reservations, or reservations explicitly designated as "Non-Refundable," no cancellation, modification, or refund shall be permitted once the reservation has been confirmed.

Such reservations are deemed final, and any payments made are non-refundable after completion of the payment process.

8. Cancellation and Refund

Reservation cancellations, refund conditions, and related matters shall be governed by the "Cancellation, Refund and Privacy Agreement" published on the website.

9. Privacy

Guest information shall be used solely for reservation management, payment processing, accounting procedures, and customer service activities.

The principles regarding the protection and processing of personal data are set forth in the "Cancellation, Refund and Privacy Agreement" published on the website.

10. Governing Law and Jurisdiction

Any dispute arising from or related to this Agreement shall be governed by the laws of the Republic of Türkiye.

11. Effectiveness

By completing a payment transaction through the website, the Guest acknowledges that he/she has read, understood, and accepted the terms and conditions of this Service Agreement.
